From the very beginning of our nation, the concept of checks and balances has been a cornerstone of our democracy. The founders of the United States recognized the potential for abuse of power and sought to prevent it by dividing the government into three branches: the legislative, executive, and judicial. However, in recent years, there has been a concerning trend of the Supreme Court enabling presidential overreach, eroding the legal limits on executive power. This dangerous shift has the potential to undermine the very foundation of our democracy.

One of the most fundamental principles of our democracy is birthright citizenship. This principle, enshrined in the 14th Amendment, grants citizenship to anyone born on American soil, regardless of their parents’ citizenship status. However, the Supreme Court has recently allowed the Trump administration to chip away at this right, with the controversial decision to uphold the administration’s travel ban targeting majority-Muslim countries. This decision not only goes against the values of our nation but also sets a dangerous precedent of allowing the executive branch to restrict the rights of certain groups of people based on their nationality.

Another area where the Supreme Court has failed to uphold the legal limits on executive power is in the realm of reproductive rights. In recent years, there has been a concerted effort to restrict access to abortion, with many states passing laws that severely limit or outright ban the procedure. These laws directly contradict the landmark Roe v. Wade decision, which guaranteed the right to abortion. Yet, the Supreme Court has allowed these laws to stand, effectively enabling the executive branch to limit a person’s right to make decisions about their own body.

These decisions by the Supreme Court not only erode the rights of individuals but also give more power to the executive branch. This concentration of power in the hands of one person goes against the very principles of our democracy and opens the door for potential abuses of power. It is the role of the Supreme Court to act as a check on the executive branch, not to enable it.

In a recent interview with The Intercept, constitutional law professor Leah Litman spoke about this concerning trend of the Supreme Court enabling presidential overreach. She highlighted the importance of the Supreme Court’s role in protecting the rights of individuals and preventing the executive branch from overstepping its boundaries. Litman also noted the need for the Supreme Court to remain impartial and independent, rather than being influenced by political agendas.

The Supreme Court’s decisions have a far-reaching impact, not just on the individuals involved in the cases, but on the entire nation. The erosion of birthright citizenship and reproductive rights are just two examples of the dangerous consequences of the Supreme Court enabling presidential overreach. It is crucial that the Supreme Court upholds the legal limits on executive power and acts as a check on the executive branch to ensure the protection of our democracy.

As citizens, we must remain vigilant and hold our government accountable. We cannot allow the erosion of our rights and the concentration of power in the hands of one person. We must demand that the Supreme Court fulfill its duty to uphold the Constitution and protect the rights of all individuals, regardless of their background or beliefs.

In conclusion, the Supreme Court’s role in our democracy is to serve as a check on the executive branch and uphold the legal limits on executive power. However, recent decisions have shown a concerning trend of the Supreme Court enabling presidential overreach, which undermines the very principles of our democracy. It is time for the Supreme Court to fulfill its duty and act as a safeguard for our rights and our democracy. Our future as a nation depends on it.
