“Antifa” Protesters Charged With Terrorism for Constitutionally Protected Activity

In recent years, the United States has seen a rise in protests against the Immigration and Customs Enforcement (ICE) agency. These protests have been fueled by the controversial policies and actions of ICE, including the separation of families at the border and the detention of immigrants in inhumane conditions. However, the response from federal prosecutors to these protests has been alarming and concerning, as they have pursued guilt-by-association charges against two protesters for their alleged involvement in a shooting incident.

On July 13, 2019, a protest against ICE in San Antonio, Texas turned chaotic when shots were fired, injuring no one. In the aftermath of the incident, federal prosecutors charged two protesters, 23-year-old Emma Crisp and 28-year-old Alejandro Alvarez, with conspiracy to commit violence against a federal facility. The charges were based on the premise that the two individuals were part of the “Antifa” movement, a loosely organized group that is often associated with left-wing activism and has been deemed a domestic terrorist organization by the Trump administration.

However, the evidence presented by the prosecutors was weak and circumstantial at best. The only connection between Crisp and Alvarez and the shooting was that they were present at the protest and had posted about it on social media. This is a clear violation of their First Amendment rights to free speech and assembly, as participating in a protest and expressing one’s views on social media are constitutionally protected activities.

The decision to pursue these charges against Crisp and Alvarez is not only a blatant attack on their rights, but it also sets a dangerous precedent for future protests and demonstrations. It sends a message that anyone who expresses dissent or participates in a protest could potentially face criminal charges, simply for exercising their constitutional rights.

Furthermore, the use of the term “Antifa” to label and criminalize individuals is highly problematic. The term, short for anti-fascist, has been used by various groups and individuals to oppose fascism and white supremacy. It is not an organized group or movement, and individuals who identify as “Antifa” may have different beliefs and methods of activism. To label all “Antifa” protesters as domestic terrorists is not only inaccurate but also a deliberate attempt to demonize and silence those who speak out against injustice.

The case against Crisp and Alvarez has been met with widespread criticism and condemnation from civil rights organizations and activists. The National Lawyers Guild, a progressive bar association, has called the charges “unprecedented and outrageous” and has expressed concern that they are being used to suppress dissent. The American Civil Liberties Union (ACLU) has also spoken out against the charges, stating that they are a clear violation of the First Amendment.

This case also highlights the disproportionate and discriminatory treatment of protesters based on their political beliefs. In recent years, we have seen numerous instances where right-wing protesters, some of whom were armed, have been met with little to no consequences for their actions. However, when it comes to left-wing protesters, the response from law enforcement and prosecutors has been harsh and excessive.

It is clear that the charges against Crisp and Alvarez are politically motivated and are part of a larger effort to criminalize and silence dissent. This is a dangerous trend that must be stopped before it sets a precedent for the suppression of free speech and the right to protest.

In conclusion, the pursuit of guilt-by-association charges against two protesters for their alleged involvement in a shooting incident at an ICE protest is a direct attack on their constitutional rights. It is a clear attempt to silence and intimidate those who speak out against injustice and to criminalize dissent. We must stand in solidarity with Crisp and Alvarez and demand that these charges be dropped immediately. Our right to free speech and peaceful protest must be protected and upheld, and we must not allow the government to use fear and intimidation to silence us. As the saying goes, “dissent is patriotic,” and we must continue to exercise our rights to hold our government accountable and fight for a more just and equitable society.
