Secretive Georgia Clemency Board Suspends Execution After Its Conflicts of Interest Are Exposed
Share on FacebookShare on Twitter

Stacey Humphreys, a death row inmate in Georgia, was scheduled to be executed on January 15, 2020. However, just days before his execution date, the state’s secretive clemency board made the unprecedented decision to suspend his execution. This decision came after the board’s conflicts of interest were exposed, raising serious questions about the fairness of Humphreys’ trial and the integrity of the criminal justice system in Georgia.

Humphreys was sentenced to death in 1995 for the murder of his girlfriend, Sandra Lee. However, his case was marred by allegations of juror misconduct, which were never fully investigated. One of the jurors who voted for his death sentence had a personal connection to the victim’s family and failed to disclose this information during jury selection. This blatant violation of impartiality not only goes against the principles of a fair trial, but it also raises doubts about the validity of the jury’s decision.

For over two decades, Humphreys and his legal team have been fighting to prove his innocence and bring attention to the flaws in his trial. Despite the mounting evidence of juror misconduct and other irregularities, the state of Georgia has remained steadfast in its pursuit of execution. It wasn’t until the clemency board’s conflicts of interest were exposed that the state’s decision to execute Humphreys was put on hold.

The Georgia State Board of Pardons and Paroles, also known as the clemency board, is responsible for making decisions on clemency requests, including pardons, commutations, and reprieves. However, a recent investigation by The Intercept revealed that several members of the board have close ties to the prosecutors and judges involved in Humphreys’ case. This raises serious concerns about their ability to make an unbiased decision on his clemency request.

One board member, Robert Keller, is a former prosecutor who worked on Humphreys’ case. Another member, Terry Barnard, is a former judge who presided over Humphreys’ trial. Both of these individuals have a clear conflict of interest and should have recused themselves from the decision-making process. Yet, they were allowed to participate and potentially influence the outcome of Humphreys’ case.

This blatant conflict of interest not only goes against the principles of fairness and impartiality, but it also calls into question the integrity of the clemency board and its decision-making process. It is deeply concerning that such a crucial decision, one that could mean life or death for a person, is being made by individuals with such clear biases and connections to the case.

Thankfully, the exposure of these conflicts of interest has prompted the clemency board to suspend Humphreys’ execution. This decision gives hope to Humphreys and his legal team that his case will finally receive the fair and impartial review it deserves. It also highlights the power of transparency and the importance of holding those in positions of authority accountable for their actions.

However, this is just the first step in the fight for justice for Stacey Humphreys. The clemency board must continue to investigate the serious allegations of juror misconduct in his case and make a decision based on the merits of the evidence. The ultimate decision on Humphreys’ fate should not lie with individuals who have a personal interest in his conviction and execution.

The case of Stacey Humphreys is just one example of the flaws in the criminal justice system, particularly in the application of the death penalty. This outdated and inherently flawed system has led to the wrongful conviction and execution of innocent individuals. It is time for Georgia and other states to re-evaluate their use of the death penalty and ensure that every individual receives a fair trial, free from biases and conflicts of interest.

In the meantime, the clemency board must continue to operate with transparency and uphold the principles of fairness and justice. The fate of a person’s life should not be determined by secretive decision-making processes and conflicts of interest. Stacey Humphreys and his family deserve a fair chance at justice, and it is the responsibility of the clemency board to ensure that this happens.

The decision to suspend Stacey Humphreys’ execution is a step in the right direction, but there is still much work to be done. It is time for Georgia to acknowledge the flaws in its criminal justice system and take action to rectify them. The fate of a human life should never be taken lightly, and
